Believe it or not, sex crimes are, next to death penalty cases, the most serious types of criminal cases an attorney can handle. Whereas even someone convicted of murder may have the possibility of parole in ten or so years, many sex crimes are punishable by 5, 15 or 25 years to life in prison. That is a mandatory sentence imposed by the Utah Legislature; meaning that if you are convicted of that crime, the judge cannot change the sentence, he must impose prison time.

Recent Sex Crime Defense Victories

Our client was facing hundreds of counts of possession of child pornography. The sentence the prosecutors wanted was a term of eighteen years at the Utah State Prison. Our attorneys fought the case for months, oftentimes negotiating with investigators and prosecutors on weekends or afterhours. The day before jury trial, the prosecutors backed down, and we secured our client a successful deal of probation with no incarceration.

Our client was charged with forcible sex abuse, a type of rape without penetration. If convicted, he would have received 1 to 15 years at the Utah State Prison along with a lifetime sex offender registration requirement. With the prosecutor unwilling to deal, we went to trial, and secured a not-guilty verdict for our client, despite the fact that there had been a taped confession to contend with (a confession taken out of context by detectives secretly recording it). Our client now lives happily with his family and has moved on from this dark period.

Our client was charged with sexual abuse of a child. Through intensive mental health screening, we were able to convince the prosecution that his problems stemmed from mental illness, not sexual predation. He was released from jail after being held without bail for four months, and received a deal that required only a ten year sex offender registration rather than lifetime.

Our client faced twenty-five years to life in prison for rape of a child. Through nearly two years of negotiation, we were able to convince the prosecution that their case was weaker than they believed. Our client received a misdemeanor with no incarceration and no sex offender registration requirement.
