Recent DUI Victories


2012: Our client was involved in a rear-end collision. When the officer arrived to investigate, he detected alcohol on our client’s breath and proceeded to initiate a DUI investigation. Through an analysis of the evidence, we determined that the officer conducted the field sobriety tests in an insufficient manner not up to the standards set forth by the National Highway and Traffic Safety Administration. We also found that the officer’s administration of the breath test was inadequate. The criminal DUI case was subsequently dismissed but the Utah Driver License Division still suspended the license. We appealed to the District Court, and won that hearing as well, returning our client’s driver license to him.

2012: Our client was arrested for DUI after several witnesses observed him leaving a park intoxicated. The officers arrived at his home and arrested him. They tackled him, held him to the ground, and took his blood without his consent. We challenged the blood, the arrest, the field sobriety tests, and everything else in the case. We won our client’s driver license hearing and then had the DUI reduced to a traffic offense. Our client was able to maintain his job which required no criminal charges on his record.

2011: Our client was charged with his first DUI and was facing the loss of his job with the suspension of his driver’s license. The prosecution thought they had an air-tight case, but we disagreed. The officer had done a poor investigation and did not perform a proper DUI stop of our client according to the Fourth Amendment. We won his driver license hearing and kept his driver license. We then managed to negotiate a deal in which his DUI was dismissed and reduced to a traffic violation in exchange for a $300 fine.

2011: Our client was stopped at a DUI checkpoint in Davis County and arrested for DUI based on failing the field sobriety tests and a belief by the officer that our client was on illegal narcotics. We disagreed. We challenged the stop, the field sobriety tests and the performance of the blood draw. We won the driver license hearing so the client was able to keep his license, and then convinced the prosecution to dismiss the case against our client entirely.
